These Terms of Use (“Terms”) set out important information about the abuse.ch platforms, which include:

(the “abuse.ch platforms”).

Please read these Terms carefully as they affect your rights and liabilities under the law to the extent you use the abuse.ch platforms. If you do not agree with these Terms, please do not use the abuse.ch platforms. By using the abuse.ch platforms you agree to be bound by these Terms.

THE ABUSE.CH PLATFORMS ARE PROVIDED FREE OF CHARGE SUBJECT TO THE FAIR USE PRINCIPLES SET OUT IN THESE TERMS. ABUSE.CH RESERVES THE RIGHT IN ITS ABSOLUTE DISCRETION TO RESTRICT, REVOKE OR PREVENT ACCESS TO THE PLATFORMS WITHOUT NOTICE WHERE IN ITS REASONABLE OPINION THE FAIR USE PRINCIPLES ARE NOT RESPECTED.

The abuse.ch platforms are operated by abuse.ch AG, a company registered in Switzerland, with UID CHE-172.684.863, whose registered office is at c/o Grant Thornton AG, Claridenstrasse 35, CH-8002 Zürich, Switzerland (“abuse.ch”, or “we”, “us”, “our”, and similar terms), in cooperation with Spamhaus Technology Limited (“Spamhaus”) as the primary licensee of the abuse.ch datasets.

The following documents also form part of these Platforms Terms of Use:

1. Authentication

1.1. Your usage rights for the abuse.ch platforms will differ depending on whether you have fulfilled our authentication process. Please visit https://auth.abuse.ch/ to authenticate your account.

1.2. Users who have authenticated their account in accordance with section 1.1 above are referred to as "Authenticated Users". Users who have not authenticated their account are referred to as "Non-authenticated Users".

2. Fair use principles

2.1. You are not automatically entitled to the use of the data available across the abuse.ch platforms. Use of the abuse.ch platforms is free of charge provided you meet all of the following criteria:

2.1.1. The abuse.ch platforms are provided free of charge to (i) Authenticated Users and (ii) Non-authenticated Users subject to certain limits that we and/or Spamhaus may apply from time to time, who are making queries to the platform APIs, each a “Query”

2.1.2. Your Query volume per each abuse.ch platform must not exceed volumes reasonably expected in circumstances of not-for-profit related usage, except as described in section 2.1.4 below (the “Query Volume Limits”).

2.1.3. Where you have exceeded the Query Volume Limits, your access to the abuse.ch platforms may be limited, and further use may become subject to a subscription as described in section 3 below.

2.1.4. Notwithstanding section 2.1.3 above, Authenticated Users may continue to use the abuse.ch platforms free of charge even where they have exceeded the Query Volume Limits, provided that the relevant Authenticated User has submitted/ is submitting a sufficient volume of data contributions to the abuse.ch platforms, which are of a sufficient quality, to qualify for ongoing free use on an exceptional basis, at our discretion. We may revoke such exceptional free use at any time provided we give you written notice

3. Commercial use

3.1. Use of the abuse.ch platforms by companies, organizations, individuals and networks with requirements likely to breach or exceed the fair use principles set out above, may require a paid subscription service via Spamhaus, which is designed for users with commercial / for-profit requirements.

4. Accuracy

4.1. We cannot promise that the abuse.ch platforms will be fault-free. If a fault occurs we will attempt to correct the fault as soon as we can.

5. Liability

5.1. The abuse.ch platforms are provided to certain non-commercial users free-of-charge and subject to the principles of fair use set out in section 2 above. Accordingly you agree that we shall have no liability to you for any losses to you caused by your use of the abuse.ch platforms. This section 5 shall not limit or affect our liability if something we do negligently causes death or personal injury.
